Omni ("Application") is a personal health, hydration, and nutrition tracking application developed and operated by Enes Beyaz ("Service Provider"). The Application is a 100% advertisement-free utility. Neither free nor premium users are shown advertisements of any kind.
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a device you own or control, for personal, non-commercial purposes.

All intellectual property rights in the Application — including its source code, design, user interface, icons, trademarks, and branding — are and remain the exclusive property of the Service Provider. Nothing in these Terms grants you any license or right to use the Service Provider's trademarks or branding for any purpose.

The Application may request access to Apple HealthKit data, including steps, active energy, sleep analysis, water intake, and nutritional metrics, solely to provide and improve Application features.

If you are a consumer resident in the European Union or European Economic Area, you have a 14-day right of withdrawal from the date of purchase of a new subscription. However, by immediately accessing premium features upon purchase, you expressly consent to the immediate performance of the digital service and acknowledge that your right of withdrawal is forfeited upon full performance. This does not affect any statutory rights you hold under applicable consumer protection law that cannot lawfully be excluded.
The Service Provider reserves the right to change subscription pricing or included features with reasonable advance notice. Continued use of the Application after a price change constitutes acceptance of the new pricing.
By using the Application, you represent that you are legally permitted to use it in your jurisdiction and that you are at least 16 years of age. If you are under 16, a parent or legal guardian must review and accept these Terms on your behalf before use.

The Service Provider may suspend or terminate your access to the Application if you materially breach these Terms. Where the breach is capable of remedy, you will be given 14 days' written notice to cure the breach before termination.
The Service Provider may suspend or terminate your access immediately and without notice if you:
Upon termination, your right to use the Application ends and you must delete all copies from your devices.
Some features require an active internet connection. The Service Provider is not responsible for the Application failing to operate at full capacity due to lack of Wi-Fi access or exhausted mobile data. If you use the Application outside a Wi-Fi area, your mobile operator's standard charges apply. Roaming charges may apply outside your home territory.
The Service Provider strongly advises against jailbreaking or rooting your device, as this may compromise device security and cause the Application to malfunction.
To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Application.
The Service Provider retains full liability for:
To the fullest extent permitted by applicable law, the Service Provider's total aggregate liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim, or the minimum amount permitted by applicable law, whichever is greater.
Nothing in these Terms limits any rights you have under mandatory applicable consumer protection law.
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless the Service Provider from and against any claims, liabilities, damages, losses, and expenses arising directly from your breach of these Terms or your intentional misuse of the Application.
This indemnification does not apply to claims arising from the Service Provider's own negligence, breach of these Terms, or violation of applicable law. In jurisdictions where consumer indemnification is restricted by law, this clause applies only to the maximum extent permitted.
The Service Provider may update the Application from time to time to improve features, fix bugs, or comply with applicable law. You are advised to keep the Application updated. The Service Provider may cease providing the Application at any time, at which point all licenses granted to you terminate and you must delete the Application from your devices.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable. The remaining provisions shall continue in full force and effect.
These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider concerning your use of the Application and supersede all prior agreements.
These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent that mandatory consumer protection laws of your country of residence apply. EU/EEA consumers retain the benefit of any mandatory provisions of consumer protection law of their country of residence. Any dispute arising from these Terms will be resolved before the courts having jurisdiction under applicable law.
The Service Provider may periodically update these Terms. Material changes will be communicated via in-app notification and posted on this page with a new effective date. Previous versions are available upon request at: support.omniapp@gmail.com
